Solitary Confinement Essay – Was This An Infringement?
The Eighth Amendment Right prohibits a number of wrongful treatments to prisoners one of which is prohibition against cruel and unusual punishments. When Johnny Davis was found fighting with his fellow inmates, he was placed in solitary confinement for a total of ten days, something he referred to as infringement of the Eighth Amendment Right. This leads to a question on the extremeness of being confined in a solitary cell for ten days. In as much as this was a punishment for wrongful opinion, this may have been a case of infringement of the Amendment Right. This is because the right is mainly concerned with extreme use of the authority that one has over prisoners. In view of the conditions for solitary confinement, a prisoner should be placed in a solitary cell for a minimum of twenty three depending on the weight of his mistake.
